I am aware that tenant landlord laws are very different in

Pregunta del cliente:

I am aware that tenant landlord laws are very different in Mexico.

My question is: who has the rights to the natural resources on a property that has been rented?

Scenario: We have a 5 year lease on a rancho in Jalisco state. We have the option to renew for an additional 5 years. We also hold an exclusive option to purchase the ranch for 5 years.

Out of courtesy we asked permission from the landlord to cut down a few dead trees for firewood. We were given permission. The landlord then told our workers to save most of the wood for him. We paid for the workers, the equipment, and the fuel to run the equipment.

Does he have the right to the wood or is it our property according to tenant laws in Mexico? We rented the whole ranch (13 hectares).

Also, the landlord is requesting we move our vehicles to a different location on the ranch. Does he have the right to request this?

We have been very kind and even allow him to come onto the ranch everyday without notice. Lately he has been making unrealistic requests and repeats himself a lot. Almost as if he has the early stages of Alzheimer.

We wish to maintain good relations, however, the unrealistic requests are becoming more frequent.

Please help clarify this issue for us here in Mexico.

Thank you.

lic.rso :

Hi, welcome to justanswer.

lic.rso :

the answer is on the lease contract, what is signed on the contract, i mean the normal thing when a property is leased, you have the rigth to use everything, the owner of the property does not have the right to do what he is asking to do to, like told your workers to save most of the wood for him, so you have the right to keep the wood for you.

lic.rso :

so if the landlord ask you to give him the wood, he has no right to do so, because mexican law protect you, and you have the right to the natural sources of the ranch, if the lease contract does not ban you to use all the natural sources of the ranch.

lic.rso :

If you have more questions, i can keep helping you to answer your questions

Customer:

Thank you for your answer. Can you give me a general guide of the renter's rights in Mexico? I understand that the contract will be the deciding factor, which it does not give the landlord any rights in this respect.

Customer:

I would however like to know the general workings of Mexican rental laws.

Customer:

Thank you.

lic.rso :

you can find a general guide in the civil code of jalisco

Customer:

Thank you. In our contract we have the right to sublease and to allow other businesses to run on the property. The landlord is upset that we may actually start a business on the property even though we had his prior permission....is there anything we can do help him understand our position? He is saying bad things about us in public and making our stay in the area difficult.

lic.rso :

what you can do is tell him about the contract you sign

lic.rso :

and that you have the right ti sublease, on the contract

lic.rso :

is your right and he cant do anything about it

lic.rso :

if he tries to go to court, he will lose the sue
