My husband is ineligible for a visa under sections 212(a)(9)(B)(i)(II)

Pregunta del cliente

My husband is ineligible for a visa under sections 212(a)(9)(B)(i)(II) and 212(a)(9)(C)(i)(I) as of dec 2008. He is living in Mexico and i and my two small children are US Citizens. Is their anyway of applying for a pardon before the ten years have passed? Or is their any other type of relief out their for him?

I am afraid that they will not waive the 10 year requirement for him under these sections. There are some attorneys out there who may take your money with promises they will work on it, but legally the courts will not issue a waiver so all you are going to be doing is spending money for them to file a petition they know will be rejected just to collect money from you. I am very sorry to hear this is happening with your husband and I know how difficult it is for you to deal with, but the attorneys that you have consulted with already telling you that there is nothing you can do before the 10 years are correct.
