My husband is currently doing a Psychiatry residency program

My husband is currently doing a Psychiatry residency program combined with child and psychiatry fellowship. He is scheduled to finish the child and adolescent psychiatry fellowship requirements on june 30th 2012 and after that he needs to finish one last year on general psychiatry. Up until last month all of his rotation and supervision evaluations where passing and he has had NO problem with the program or any supervisor before. In April (2 months aprox before his scheduled finishing date for child and adolescent requirements 30th june 2012) his supervisor did a meeting to tell him he had a lot of deficiencies (non of them addressed until now) and that if he did not improve they where not going to let him finish his fellowship as scheduled. Prior to this there are no bad evaluations or complaints to his job or training. Since then he been everything they have told, all the extra requirements they have given him but yesterday they told him (by email)that he is still not passing and added extra requiments and gave him a due date of june 20th. As stipulated by ACGME (the people who give accreditation to child and psychiatry fellowship program) program directors are supposed to give regular feedback and develop realistic action plans to achieve program requirements. This was not done. Two months before program requirements completion date is not sufficient time to assess defiencies and schedule and implement action plan to see improvement.

If the hospital has not kept up with their duty to him to provide regular feedback or the feedback they have provided has all been positive and suddenly he is getting negative feedback, then this is grounds to first appeal the negative feedback through the board overseeing fellowships. If the board does not find in his favor, he would have to file suit in court for breach of the fellowship contract for failure to follow the ACGME guidelines and for providing all positive feedback and then suddenly changing without warning and argue this is arbitrary and capricious and is being done for some retaliatory or unlawfully discriminatory purpose (which is what the circumstantial nature of a sudden 180 degree turn in his performance evaluations would suggest). At this point he should consider getting a local employment law attorney to assist him in appealing this to the board and taking it to court if that is required.

Can I get an example of how exacly we can inform ACGME of what is going on. I am scared that they could take negative action towards my husband.

Stick to only the facts of your husband's case as they directly pertain to the ACGME guidelines and try to stay away from personal attacks or allegations that are not supported by the rules for accreditation.
