A 42 yo male,Cuban arrived in Canada and went accross the Niagara Falls bridge. He is at the US Immigration office there. He was told that they are not responsible for him. The Cuban has my phone because he is related to a cousin in Cuba that I have not seen in 45 years. The officer told me that they were going to take him somewhere. I told the officer that Cubans have a right through the Cuban Adjustment Law to received help once they are processed by inmigration. Would you tell me if I am mistaken? I can not offer shelter
Hello. You said he arrived in Canada. The Cuban Adjustment Act only applies to someone in the U.S. Did you mean to say that he arrived in the U.S.?
Yes he is at the USA shelter house Vive La Casita in Bufalo, NY. He just arrived there.
Ok. The Cuban Adjustment Act he can only apply for after being in the U.S. for 1 year and 1 day. For now, he has to request Asylum and go through a credible fear interview and with luck, they will parole him into the U.S. then it will probably take around a year to start the court hearings and when he gets to one year and one day in the U.S., he can withdraw the Asylum and file the I-485 to get Cuban Adjustment. If he is aproved for the sylum. He already went today through I suppose when he arrived at the USA gate and then transferred to a shelter. What is next? I understand that he gets help with housing, stamps, etc
I do not know where he will be going to, that will be probably determine by the US Federal assistance program since he does not have family for shelter. Yes I will like to have as much information. He is at a shelter called Vive La Casita in bufalo, NY. Thank you for your assistance
