Hi again. yes, I'll contact an attorney, but I just want to make sure that a summons is not an agreement from both parts: am I correct? Is there another way to validate an agreement apart from summons? I mean, if we write an agreement, a document we agree on, and then we take it to court, it is not necessary to take the summons way, is that right? Or is it the only way?

A summons means she has started a court action against you. you can still have the agreement accepted by the court even with the summons. once you appear in court, you can let the court know you have an agreement, the judge can accept the agreement and put the agreement in a final order. the case will then be finished. So there is still time to get the agreement before the court. A summons is just opening the case, it does not mean that you cannot still have an agreement between you two. Thanks for your answer. I'm asking you all this because I've read that if a summons process starts, then it will be impossible for me to get a green card in case I want to go to the US to live and work (since it's possible that I open a company there). SO i really don't want legal problems and/or residence impediments in the US just because this summons process. That's why I'm asking if the summons is the only way to legalize the agreement in front of a judge, or are there other ways to do it.

a civil case has no affect on your ability to get green card here in the u.s. only a criminal case or criminal conviction can cause you to be denied a green card. So again, she filed a summons to start the case but you both can end the case by agreement. if you cannot agree, then the judge will decide the case but either way this kind of case is not criminal and therefore will not hurt your future green card chances.
